Terms of Service
1. Acceptance
By accessing or using the P26M payment orchestration platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form the entire agreement between you and P26M and supersede all prior representations.
2. Service description
P26M provides payment orchestration: smart routing of payment transactions across multiple PSP integrations, automatic failover, unified reporting, and a merchant dashboard. The Service does not itself hold merchant funds or issue payment instruments.
3. Eligibility & KYB
The Service is available to legally incorporated businesses only. Individuals may not open merchant accounts. You must successfully complete Know Your Business (KYB) verification before accessing live payment processing. P26M may require re-verification at any time to comply with regulatory obligations.
4. Account & access
You are responsible for maintaining the confidentiality of your API credentials and for all activity that occurs under your account. Notify us immediately at the support address below if you suspect unauthorized access. We reserve the right to suspend accounts showing signs of compromise pending investigation.
5. Fees & billing
Fees are set out in your Merchant Agreement. The platform operates on an Interchange++ model: you pay the actual interchange cost plus a fixed P26M markup disclosed before signing. Monthly platform fees are billed in advance; transaction overage fees are billed in arrears. Disputed invoices must be raised within 14 days of the invoice date.
6. Acceptable use
You must not use the Service to process payments for:
- Fraudulent, deceptive, or illegal transactions.
- Prohibited industries as defined in your Merchant Agreement (including but not limited to: illegal gambling, weapons, controlled substances).
- Transactions that violate card network rules (Visa, Mastercard, or applicable scheme).
- Any activity that would expose P26M to regulatory sanction or reputational harm.
Violation of this section may result in immediate account suspension without prior notice.
7. Liability & indemnification
THE SERVICE IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PERMITTED BY LAW, P26M IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
Our total aggregate liability to you in any 12-month period shall not exceed the platform fees you paid in that period.
You agree to indemnify and hold P26M harmless from any third-party claim arising from your use of the Service in violation of these Terms.
8. Confidentiality
Each party agrees to keep the other's confidential information (including pricing, API documentation, and technical architecture) strictly confidential. This obligation survives termination for 3 years.
9. Termination
Either party may terminate the agreement with 30 days' written notice. P26M may terminate immediately for breach of Section 6 (Acceptable use), non-payment exceeding 30 days, or regulatory requirement.
On termination, you retain access to your transaction data export for 30 days. After that period, data is deleted per our Privacy Policy retention schedule.
10. Governing law
These Terms are governed by the laws of the European Union jurisdiction in which P26M is incorporated. The specific jurisdiction is set out in your Merchant Agreement.
11. Disputes
The parties agree to attempt good-faith negotiation before initiating formal proceedings. If negotiation fails within 30 days, disputes shall be submitted to binding arbitration under applicable EU rules, unless either party seeks interim injunctive relief from a competent court.
